ENTRY CONDITIONS FOR THE ART COMPETITIONS

  1. The Art Competitions are conducted by 2XCubed Pty Ltd ACN 152 306 422 of 1/84 Hindley Street, Adelaide SA 5000 Australia ("we/us/our").
  2. By entering a Competition, you acknowledge that you have read and understood, and agree to be bound by these conditions.
  3. The Competitions are open to any person over the age of 15 years who accepts these conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MAY NOT ENTER A COMPETITION.
  4. The Forgotten Island Competitions have been created for the submission of original artwork, music or textual storylines ('Work') capable of incorporation into our entertainment property called Double Happy Vs. The Infinite Sadness.
  5. Employees and their immediate families of 2XCubed Pty Ltd and its associated companies are not eligible to enter.
  6. The Competitions are conducted from time to time at our discretion. The opening and closing dates will be published in the Competitions section of the Double Happy Website - www.doublehappyrabbits.com.
  7. THE SUBMITTED WORK MUST BE YOUR ORIGINAL WORK AND MUST NOT CONSTITUTE AN INFRINGEMENT OF THE INTELLECTUAL PROPERTY RIGHTS (INCLUDING THE MORAL RIGHTS) OF ANY OTHER PERSON. BY ENTERING A COMPETITION, YOU GIVE A WARRANTY TO THAT EFFECT.
  8. The Work must be submitted in accordance with our guidelines and specifications.
  9. You should enter the Work only once. Multiple entries will be treated as the same entry.
  10. Our decision in relation to each winning entry will be final and we will not enter into correspondence regarding the result of a Competition.
  11. All entries are submitted on condition that you grant us a worldwide perpetual non-exclusive licence, at our discretion, to publish your Work on the Double Happy website, in the Double Happy Newsletter, in Double Happy promotional emails and throughout any other places that Double Happy appear both online and offline including but not limited to Facebook, Twitter, third party art forums and magazines, showing your name as the creator of the Work.
  12. It is a condition of entering each Competition that:
    1. (a)you give us the exclusive first option to acquire any or all of the intellectual property rights pertaining to your Work that we may select by notice in writing within one year of the submission of your Work, setting out the terms on which we are prepared to acquire the relevant rights;
    2. (b)to the extent necessary, you agree to enter into negotiations with us in good faith in relation to the relevant rights;
    3. (c)if you wish to accept our offer to acquire the relevant rights, you will notify us of your intention within 14 days after the receipt of our offer;
    4. (d)if you do not accept our offer or if we and you have not agreed on the terms on which we will acquire the relevant rights, you will be free to enter into negotiations with another person in relation to the relevant rights but only for a fee and on terms which are equal to or no less favourable than those offered by us; and
    5. (e)if you wish to offer terms to acquire the relevant rights to another person that are less favourable, you must first offer those terms to us and we shall have 14 days to respond.
  13. The prize for each Competition will be advertised on the Double Happy website and in the Double Happy Newsletter and through Facebook and Twitter.
  14. An entry will be treated as void and the prize will be forfeited if it comes to our attention that the submitted Work is not your original work.
  15. The winner will be notified by email at the address included in the winner's entry including instructions in relation to the delivery or collection of the prize. The winner's name will also be published for a period of up to 30 days in the Double Happy newsletter and advertised through Twitter and Facebook and on the Double Happy website within 7 days of the Competition closing date.
  16. We reserve the right to suspend or bar a person from entering a Competition or to reject an entry at any stage of a Competition or thereafter. We will communicate any such decision by to the person affected by email.
  17. We reserve the right in our absolute discretion to cancel or withdraw a Competition. We will give notice of any such cancellation or withdrawal via the Double Happy website - www.doublehappyrabbits.com.
  18. As a result of registering on the Double Happy website to be eligible for a Competition, we will collect certain personal information about you. We collect your personal information to process your Competition entries, to notify the winner, to allow us to inform you of other deals or offers associated with the entertainment property entitled Double Happy vs. The Infinite Sadness and to allow us to know your gender and age in order to help us design and improve our products and services.
  19. You consent to receiving emails from us concerning any Competitions you enter. Unless you refuse your consent by writing to us at admin@doublehappyrabbits.com, you also consent to receiving promotional emails about new competitions and any other news relevant to the entertainment property entitled Double Happy vs. The Infinite Sadness. You can also opt out of receiving promotional emails at any time by clicking the 'unsubscribe' link contained within the email and following the instructions.
  20. Unless you refuse your consent sending an email to admin@doublehappyrabbits.com, you consent to the use of your personal information for the secondary purpose of research about our user database, to give us a better understanding of the age, gender and interest of users, in order to help ensure that our entertainment properties are relevant and enjoyed by our audience.   21. You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of you entering a Competition and arising out of any claim that the Work you submit is an infringement of a third party's intellectual property rights (including their moral rights).
  22. We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in a Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of a Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  23. We are not responsible for lost, late, incomprehensible or incorrect entries in a Competition. We are not responsible if your entry is not received, for any reason, by our email server.
  24. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend a Competition.
  25. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
  26. We are not liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter a Competition or using a prize won in a Competition, except for any liability which cannot be excluded by law.
  27. These conditions constitute the entire agreement between you and us as to its subject matter. By entering a Competition, you accept that the agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in South Australia, in accordance with the laws in force in South Australia from time to time.
